IRS Proposes Tighter Premium Tax Credit Eligibility: What Marketplace Buyers Should Know
Week of October 12, 2026 update. Published October 15, 2026.
What the Premium Tax Credit is
The Premium Tax Credit (PTC) is a refundable tax credit that helps eligible individuals and families with low or moderate income afford health insurance purchased through the Health Insurance Marketplace. Because it is refundable, you can benefit even if the credit is more than the tax you owe.
What Treasury and the IRS announced on October 14, 2026
The U.S. Department of the Treasury and the IRS issued proposed regulations to implement the Working Families Tax Cuts reforms to the Premium Tax Credit. According to the IRS announcement, the proposed rules would:
- Strengthen eligibility standards so that, beginning in 2027, taxpayer-funded health insurance subsidies go only to people who qualify under federal law.
- Restrict Premium Tax Credit eligibility to U.S. citizens, U.S. nationals, and certain lawfully present noncitizens.
- Close verification gaps by applying eligibility checks and adding new verification criteria for any advance payments of the credit.
Important: these are proposed regulations, available in the Federal Register. They are not final rules. The IRS also noted that the Department of Health and Human Services is expected to issue its own parallel proposed regulations about Marketplace procedures.
What this means for you
If you buy your own health insurance through the Marketplace, nothing changes today. Your 2026 coverage and any advance premium tax credit you receive now are not affected by a proposal. Final rules, when they come, would matter starting with the 2027 coverage year and filing season.
What to do now
- Keep your Marketplace paperwork, including Form 1095-A, which arrives each year and is used to reconcile the credit on your return.
- Report household changes during the year, like income or family changes, to the Marketplace, because they affect your credit.
- Bring your questions to tax time. We watch these rule changes closely so you do not have to.
